By accessing or using the UmemeNex website (the "Site") to purchase headphones, game controllers, or keyboards, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services. UmemeNex reserves the right to update or modify these terms at any time without prior notice. Continued use of the Site after changes constitutes acceptance of the new terms.

You agree to provide accurate, current, and complete information when placing an order. All purchases are subject to product availability and confirmation of order details. UmemeNex does not maintain a user account system; therefore, all transactions are processed on a guest basis. Order confirmations and communications will be sent to the email address you provide during checkout.

2. Limitation of Liability

UmemeNex, its affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased, including but not limited to headphones, game controllers, and keyboards. This includes, without limitation, damages for loss of profits, data, or business interruption, even if UmemeNex has been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these terms or any product sold through the Site shall not exceed the purchase price of the product giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such cases, liability will be limited to the fullest extent permitted by applicable law.

All content on the UmemeNex Site, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of UmemeNex or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content without prior written consent from UmemeNex.

The trademarks, service marks, and trade names displayed on the Site (e.g., "UmemeNex") are registered and unregistered marks of UmemeNex. Unauthorized use of any intellectual property is strictly prohibited. Any feedback or suggestions you provide regarding our products or services become the property of UmemeNex and may be used without compensation.

4. Refund Policy

UmemeNex offers a 30-day refund policy from the date of delivery for defective or incorrect products. To initiate a refund, please contact us at [email protected] with your order number and a description of the issue. Refunds will be processed within 10 business days after we receive and inspect the returned item, subject to the following conditions:

  • Products must be returned in their original packaging with all accessories and documentation.
  • Refunds are only applicable for manufacturing defects or items not as described; normal wear and tear or damage caused by misuse are not covered.
  • Shipping costs for returns are the responsibility of the customer unless the defect is confirmed by UmemeNex.
  • Refunds will be issued to the original payment method used during purchase. No exchanges are offered; instead, a refund can be used to place a new order.

5. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal actions or proceedings arising out of or related to these terms shall be brought exclusively in the courts located in Delaware.
